1) Minutes: Minutes of the May 15, 2007 board meeting were approved.

2) Financial report:

a) FY2006 audit: Jordan Kurs reported that the FY2006 is reaching completion and that the auditor was at the offices of TKR reviewing records in the last couple weeks.

b) Delinquent account balances of unit owner were discussed. One owner has paid their balance. A second owner’s full payment is expected in several days. Legal action with building attorney moving ahead with others.

c) Delinquent owner account balance fee: An email vote was conducted in the week following the May board meeting modifying the board’s May 15th decision on late fees. Board members voting in favor of changing the monthly late fee effective July 1, 2007 to 10% of the unit owner’s past-due account balance: Bellini, Boynton, Cann, Cannon, Cohen, Colford, and Lamoglia. Richard Re opposed the decision, voting in favor of keeping the first month’s delinquency at it’s current fixed $20 fee with a 10% charge only in later months; or 5% on all balances. No vote was received from Miram Biren.

d) Lease/Rental Fee: An email vote was conducted in late May concerning revision of Highview’s current $300 lease/rental fee. The Board approved revisions, increasing the initial fee to $500, with a $300 annual renewal fee on all leases; the policy to become effective with all approvals requested on or after July 1, 2007. Board members voting in favor of the decision: Bellini, Boynton, Cann, Cohen, Colford, and Lamoglia. Richard Re opposed the decision, voting in favor of a $300 initial (as it has been in the past) and $200 annual renewal fee. No vote was received from either Miram Biren or Marjorie Cannon.

3) Legal:

a) Arrears: There was discussion of common charge arrears and legal actions underway with building attorney Michael Swaaley. One unit in particular was discussed on account of Highview’s bylaws making it impossible for the board to approve a unit owner’s lease while any balance remains on a unit owner’s account.

Although the outstanding balance on the unit owner’s account made it impossible to approve a lease, the unit owner had not applied for board approval of the lease to date and a tenant had already moved in. According to bylaws, the board confirmed with management that a $500 non-compliance fine for the absence of a lease should be imposed. Management also noted that an additional $500 fine had been imposed for recent unauthorized work performed on common property. It was noted that damage had been reported at the time by 5 surrounding units.
