Highview Condominium II
Board of Directors - Meeting Minutes
September 18, 2007, 7:30 p.m.

The twelfth meeting of the 2006-2007 Highview II Board of Directors was called to order at 7:40 p.m. by Richard Re, President.

Board members in attendance: Miriam Biren, Victor Bellini, Robert Boynton, Joseph Cann, Marjorie Cannon, Stacey Cohen, Nora Colford, Al Lamoglia, and Richard Re. Jordan Kurs attended from TKR Property Services.

1) Minutes: Minutes of the July and August meetings were approved.

2) Financial report:

FY2006 audit: The auditor still needs the actual receipts from items paid from the assessment in order to complete the FY2006 audit.

3) Legal:

a) Local Law 11 inspection bids: The bid from Becht Engineering was approved.

b) Verizon/FIOS installation: Verizon indicates that FiOS will be installed in October.

c) Garage complaint: In response to an initial complaint by made by the resident of parking space #7, it was determined that a vehicle belonging to the resident space #9 was parked in such a way as to block access for the resident of space #8, which then forced the resident of space #8 to angle his car in his space and thereby interfere with access to the resident of space #7. Tamara Keshecki (owner of space #9) joined the board meeting at 8:00 p.m. to discuss the issue.

Keshecki indicated that her deed allows for two cars, providing a right for her to park over the boundary line and into space #8 owned by unit 6-D. Keshecki was asked to provide evidence to support this claim, however no documentation was presented. Richard Re stated that the Board had the building’s attorney investigate the deed for unit 1-J in Richmond County records. Highview’s attorney reported that he found the record of a parking space easement attached to the unit’s deed in standard form, but there was no mention of how many vehicles were allowed in the space. The board discussed wording in the Prospectus regarding the parking spaces, which similarly makes no mention of special circumstances and only states that parking spaces for 16 vehicles was available for sale at the time of the initial offering. As there are 16 spaces attached to 16 individual Highview II apartment units, no evidence was discovered to suggest that any owner has a right to park cars in such a way as to interfere with another unit owner’s right of access to their parking space.

Following Keshecki’s presentation, the board tabled the matter for further investigation and discussion with the owners of the affected spaces -- units 6-D (space #8) and 5-C (space #7).

d) Elevator maintenance contract and repairs: No update on the legal action begun last month.

e) Unit Arrears: Legal action is being taken against units in arrears.

f) Sales and lease application files: Approximately 7 unit owners have not provided current leases for their rentals and are subject to $500 per month fines.

g) Video Security: Al Lamoglia requested that although he was not present at the August board meeting when the security system’s new digital recorder was approved, he wished to have his vote against the system recorded.

4) Maintenance:

a) New building super: On August 22, 2007, the board completed an email vote to hire Jose Cerritos. There were no dissenting votes.

b) Entrance Awning: The new awning is draining towards the building. Sign Art will adjust. There is also a recent dent and tear. Sign Art will repair.

c) Roof Exhaust Fans: Becht Engineering conducted a recent inspection on the roof fans and indicates that all fans are operating. No air flow measurements were taken. Four of the fans were not the horsepower specified in the contract and require replacement, one motor or fan was not in balance and was vibrating, and all fans were running at their maximum speed which was supposed to be adjusted down during air-flow measurements conducted after installation. The purchase contract needs to be reviewed since the building followed Becht’s spec. recommendations and there is no reason for the fans to not e the ones specified by Becht.

d) Super’s Apartment: The board approved $3,500 for apartment repairs in response to a written estimate from the super. Boynton requested that a board member act as liaison to the super and monitor the expenditure. There were no volunteers.

e) Plumbing problem: The board approved clearing blockages in the lobby level water service lines.

f) Sidewalk repairs: The board requested estimates from TKR for repairing sidewalks, including investigation of the erosion under the curb along Clove Road.

g) Jordan reported that two new chute doors are on order to repair broken ones.

h) Elevator: Repair estimates are out for bidding.

i) Entrance area signage: New entrance, exit, and towing signs were installed today on the driveway. The board expressed dissatisfaction with the new signs. The entrance and exit signs were supposed to be similar to the originals, however were not. The towing sign was smaller than the original and was glued on top of the older (larger) sign presenting a poor appearance on account of the older/larger sign still partially exposed. Jordan will have all of the signs replaced as requested. It was also noted that the additional freestanding no parking sign was to have had its pole replaced and have been reinstalled. It was noted that these repairs were first discussed in March.

j) Exterior tile crack: There was no update on repair of the exterior tile crack in front of the building mentioned at the March board meeting.

k) Parking lot pavement cracks and sealing: The parking lot will be sealed shortly.

l) Painting of parking lot walls and garage walls: The super has been painting the parking lot walls.

m) Hall carpeting replacement: Estimate was received from Carpets on U.

n) Water filtration system: No update.

o) Jordan Kurs indicated that the sink hole and broken underground drainage pipe in front of the building is still being investigated.

The meeting adjourned at approximately 9:30 p.m.
