1) Minutes: Minutes of the September 12, 2006 board meeting were approved.

2) Capital Projects update:

a) Roof rebuild update: The sign-off has not been completed.

b) Exhaust fan repairs and duct blockages: Concerning reports that apartments 1-H, L-D, and L-F are still blocked, the board recommended at the September meeting that Chopak confirm that the lowest unit of each line be inspected to confirm system’s operation. Chopak reported at this meeting that the inspections have not been made.

c) Lobby-level hallway lighting The new sample lighting fixture approved by the committee is expected later this week. Once installed and appearance is approved, six additional units will be ordered to replace the other remaining fixtures.

4) Financial report:

a) Refunds due to the unit owners who selected Option #1 last year (fall 2005 full payment in advance) will be made by the end of October.

b) Owners who selected Option #2 (one year of interest with balance due fall 2006) had until 09/22/06 to pay their balance. Three unit owners availed themselves of this option.

c) All other unit owners automatically defaulted to Option #3 (the full five-year loan) and the five-year loan was finalized on October 1, 2006.

d) $8,000 (surplus of the ~$300,000 unit assessments) was transferred to Highview’s Capital Reserve account.

5) Legal report:

a) Time Warner Cable installations: No update from Chopak concerning the notices sent to four unit owners for improper installations by Time Warner Cable and the corrective actions required. Chopak stated at the September meeting that he would set up a meeting at the building with Time-Warner and board representatives, but there was no progress to report at this meeting.

b) Driveway parking: At the July board meeting, the board had requested that Chopak forward a list of the towing services he had spoken with and the policy of each relative to payment for the board to follow-up with for additional discussion and to perhaps explore the situation with other towing services that Chopak did not contact. It was noted that there was no update on this request at the August, September, or now October meetings.

c) Verizon upgrade proposal: At the August meeting, the board expressed its interest in the proposal, pending resolution of a signing bonus, confirmation that Verizon would guarantee continuing full operation of the entrance system, and review by the building’s attorney Michael Swaaley. There was no update at this meeting.

d) Election of board Treasurer: Held off until next meeting.

e) Insurance and liability of individual unit owners: Miriam Biren raised the question of whether unit owners could be required by the board to carry insurance that would cover the type of water damage she has suffered in recent years. The board will investigate whether a building rule could address this liability.

6) Building Maintenance & Repairs:

a) Elevator mechanical systems:

i) Concerning the elevator evaluation performed by Vertical Systems Analysis (VSA) on May 2, 2006, McGlynn Hayes has not corrected all twenty-seven deficiencies covered under their maintenance contract but they are making progress.

ii) The board requested an update from Chopak on the similar list of deficiencies identified in VSA’s May report that were not covered by any maintenance contract. The board had requested estimates on these repairs at the May meeting. Chopak indicated that there had been to effort made to address these concerns, but he would take action immediately.

b) Ceiling leaks: There was no update on the ceiling leaks reported by owners (3-B, 3-F, and 5-J) originally discussed at the May board meeting.

c) Window leaks: Becht Engineering has completed site inspection. Final report anticipated shortly.

d) Driveway entrance sign: Bellini has the catalogue for replacement of the driveway "entrance" sign. Selection process continues. He will make a recommendation shortly.

e) Smoke detector battery replacement: The building super started this fall’s semi-annual replacements of smoke detector and CO2 detector batteries for all unit owners. No update by Chopak at this meeting.

f) Garage exhaust timer repair: As first discussed at the June board meeting, the garage exhaust timer is still not operating. August 9, 2006 invoice indicates that a new timer was ordered on that date. Chopak reported at the September meeting that the fan would be repaired the week following the board meeting. At this meeting, Chopak reported that the fan will be repaired in the next couple weeks. It was again noted that this is a code violation which should have been immediately corrected and that two lobby-level unit owners had complained that their CO2 detectors had been set off by engine fumes in the garage.

g) Façade restoration: Per September board meeting and negotiation by board president, Remco bid was approved by the board.

Following the approval, further discussion concerning warranty has led Rich Re to suggest board change their votes to Altus. Boynton asked questions about painting process, type of primer and paint, and requested 24 hour delay in the vote in order to get answers to the technical questions from Altus. Board member’s request was denied. There was a follow-up request that the board consider delaying the façade restoration until spring. Request denied on account of the current appearance and condition of the façade (worn off and peeling paint, detached panels, and holes) and the need to have awning removed while façade is restored. Board approved Altus bid for primer, two coats of paint, plus removal and replacement of caulking. Rich Re will confirm details with Altus. Dissenting vote by Lamoglia noted.

h) Entrance awning: The board approved Sign Art bid on awning and frame replacement. Funding for this job is provided by the insurance settlement from Access-a-Ride who damaged the awning frame last year. Work to being once façade is refinished.

i) Maintenance Liaison: Victor Bellini reported as "Maintenance Liaison. He has been working with Joel to develop a comprehensive list of building needs.

j) Garage security: At the September board meeting, Chopak was asked to get estimates from the building’s current provider in addition to the upgrade estimate he provided from a Brooklyn vendor. No estimate was available at this meeting. Chopak indicated that he has not contacted them.

k) Lobby refurbishment: On account of the lobby-level hallways’ current condition, the board decided to form a committee to determine various restoration options for the board to consider. There was no update from the committee as the committee thought they had been told to hold-off on their investigations. This was clarified and the committee will move ahead and continue exploring options.

l) Exterminator: There was discussion of rat holes near the garbage cage and roaches in the compactor and recycling area. Chopak recommended changing exterminators and proposed 1-year contract for board approval. The board approved the change in exterminators, subject to no contract commitment by Highview.

m) Exterior screens on HVAC units: There was discussion of birds building nests in the units. A number of units do not have exterior exhaust grids on account of the fire escape structure. In the past, Highview has had the super correct these problems by covering the openings with a heavy duty screening. Irwin will discuss with the building super and report back at next meeting.

n) Landscaping and lawn maintenance: There was a discussion of Gary’s Landscaping concerning the quality of work and timely billing. Additional discussion of owners planting bushes, etc. without board approval.

The meeting was adjourned at approximately 10:00 p.m.
