Highview Condominium II
Rules and Guidelines

Leasing Your Unit

If you are planning to lease your unit, it must be leased according to the provisions of the Condominium By-Laws (Article VII, Section 1-b). The following procedures are to be followed to allow for completion of paperwork connected with leases of units. This procedure also ensures that the Board of Managers is aware of the status of units.

1. Prepare Lease Application. This form is available from the management office. The purpose of this form is to initiate processing of the lease and to allow the records of the Condominium to be updated with proper mailing addresses, phone numbers, and emergency contact information.

2. Forward a copy of the completed lease to the managing agent’s office with a) a check for $300 from the unit owner and b) a check for $200 from the prospective tenant. Both checks should be made payable to Highview Condominium II.

3. All leases must be in writing in the current form of apartment lease recommended by the Real Estate Board of New York. No exceptions will be made to this requirement. All leases must have a rider attached that obligates the tenant to abide by the current rules and regulations of the Condominium. Leases must be made subject to the declaration and bylaws of the Condominium and may not be modified, amended, extended, assigned or sublet without the consent of the Board of Managers. Leases must be a minimum of one year in length. A current copy of the lease must be on file in the management office. (See Article VII, Section 1-b.)

4. Subletting of units by tenants is prohibited. The lease must have a prohibition against sublets.

5. The Board of Managers has 30 days after receipt of the completed lease to exercise their right of first refusal.

6. All unpaid common charges, assessments, late charges, fines or other fees due to the Condominium must be paid in full before a lease is approved. (See Article VII, Section 9.)

7. Any lease that violates this procedure results in a fine of $500, imposed against the owner. Non-payment of the fine results in a lien being placed on the unit.

8. For lease renewals of current approved tenants, forward a copy of the completed lease to the managing agent’s office with a check for $300 from the unit owner made payable to Highview Condominium II.   All unpaid common charges, assessments, late charges, fines or other fees due to the Condominium must be paid in full before the lease renewal can be approved.
