Highview Condominium II
Rules and Guidelines

Carpeting Requirement/Noise Violation

According to both the condominium's Bylaws and the Rules & Regulations, all units are required to keep all floors covered with padded carpeting with the exception of bathrooms and kitchens.

In case of a noise complaint indicating "Excessive noise due to lack of carpeting", the Rules & Regulations call for a unit to be inspected by management to verify that eighty percent (80%) of the unit's square footage is covered with padded carpeting.

The square footage of each unit is provided in Schedule A of the Highview Condominium II Prospectus.  The Prospectus is conveyed to new unit owners through their attorney before or upon closing.

(Note: For reference, a copy of the Prospectus is also contained on this website.)

Management's inspection will record that either a unit is fully carpeted (wall-to-wall, with the exception of bathroom and kitchen) or document an actual inventory of padded area rugs and their dimensions for a calculation of cumulative square footage.  Management will then compare the cumulative square footage within the unit to the square footage specification for that unit and provide a written report of their findings in response to the noise complaint.

If a unit is found to be out of compliance or fails to schedule an inspection with management within 10-days of notification of the complaint, a fine may be imposed for the noise violation.  Additional monthly fines may be added to the unit owner's account until the unit is inspected my management and proves to have achieved 80% coverage.
